HON'BLE MRS JUSTICE ANIS C.M.A. No. 449 of 2006 JUDGMENT:

This Civil Miscellaneous Appeal is filed challenging the order dated 28.4.2006 passed by the I Additional Chief Judge, City Civil Court, Secunderabad, in I.A.No. 836 of 2006 in O.S.No. 40 of 2006.

As seen from the record, the First Additional Chief Judge, City Civil Court, Secunderabad, vide his letter dated 6.6.2016 informed that O.S.No. 40 of 2006 was dismissed for default on 21.9.2010 as plaintiff called absent.

In view of the same, this Civil Miscellaneous Appal has become infructuous and accordingly, the same is dismissed as infructuous. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, pending if any, shall stand closed.
