The grievance of the petitioner is that despite the order dated 15.07.2017 of the 4th respondent Assistant Inspector of Fisheries, Kanigiri, Respondents 5 to 7 officials have not been providing police protection to the petitioner society. The petitioner submits that through the order dated 15.07.2017, the Inspector of Police and the Sub-Inspector of Police, Pamarru Police Station, Prakasam District were informed that the petitioner society is entitled to catch fish in Mopadu Reservoir for Fasali 1427 i.e. from 01.07.2017 to 30.06.2018, but however, no protection is being provided by the police personnel.
Heard learned counsel for the petitioner as well as learned Government Pleader for Fisheries (Andhra Pradesh). As can be seen from the material placed on record, it is not discernible against whom the petitioner had made a complaint and who are the persons preventing it from catching the fish. In those circumstances, there cannot be any blanket direction to the respondent. Though the learned counsel for the petitioner places on record the order dated 14.02.2017 in Writ Petition No. 4981 of 2017, this Court is of the opinion that the same has no application to the present case on hand, as in the said Writ Petition, a specific allegation was made with respect to four persons and hence, a direction was given to the respondents to take necessary action. In the instant case, the petitioner has not approached the respondent police making a complaint against any specific individual.
The Writ Petition is therefore, closed, giving liberty to the petitioner to approach the respondent officials by making a complaint with specific details. As and when such a complaint is made, the respondents shall take necessary action, in accordance with law. No costs.
Consequently, the miscellaneous Applications, if any shall stand closed.
