HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10977 of 2015 ORDER:
This petition is filed by the petitioners - A9 to A15 under Section 438 Cr.P.C. seeking to grant anticipatory bail in Crime No.385 of 2014 on the file of Tadipatri Urban Police Station, Anantapuram District, registered for the offences punishable under Sections 147, 148, 302 and 120(B) IPC.
Heard and perused the material available on record. Learned counsel for the petitioners submitted that initially the petitioners were shown as accused in the above said crime, but after completion of investigation, the police filed charge sheet deleting the names of the petitioners. He further submitted that subsequently, the de facto complainant filed a private complaint before the Judicial Magistrate of First Class, Tadipatri, and basing on same, the learned Magistrate took cognizance against the petitioners and issued NBWs and hence, the petitioners filed this petition apprehending arrest in the hands of the police.
It is informed by the learned Public Prosecutor that the petitioners have filed Crl.R.C. No.2472 of 2015 against order of taking cognizance against them by the learned Magistrate and this Court while ordering notice in the said revision, granted stay of arrest of the petitioners.
When the order of stay of arrest of the petitioners, passed in Crl.R.C. No.2472 of 2015, is still subsisting, the apprehension of arrest of the petitioners, does not arise. The respondent police shall follow the directions already passed in Crl.R.C. No.2472 of 2015, till disposal of the said revision.
Hence, the Criminal Petition is dismissed as infructuous. _______________ RAJA ELANGO, J October 29, 2015.
