THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.5179 of 2013 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C seeking to quash the proceedings initiated against the petitioner/A2 in Crime No.484 of 2012 of Women Police Station, Central Crime Station, Hyderabad, registered for the offences punishable under Sections 498-A, 406 IPC and Sections 4 and 6 of the Dowry Prohibition Act. The allegations, in brief, are as follows: The second respondent-de facto complainant married the non-petitioner/Mohd. Dastageer on 16.03.2012. Immediately after about one month of the marriage, the husband of de facto complainant went to Saudi Arabia leaving the de facto complainant with his mother viz., the petitioner/A2. The mother-in-law of de facto complainant started subjecting the de facto complainant for harassment and used to torture her for several reasons. In spite of the intervention of her husband, there was no difference in harassment and the same continued. Hence, the complaint.

There are specific allegations against the petitioner/A2. As a matter of fact, it is the petitioner/A2, who is alleged to have subjected the de facto complainant for harassment. In that view of the matter, the proceedings against the petitioner cannot be quashed, and the petition is liable to be dismissed.

In the result, the Criminal Petition is dismissed. The Investigating Agency is directed to proceed with investigation without effecting arrest of the petitioner/A2, who is a lady aged about 60 years.

Miscellaneous Petitions, pending if any in this Criminal Petition, shall stand closed.
