THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.23712 of 2010 ORDER :

This writ petition is filed to declare the action of the respondents in trying to retire the petitioner from service on the ground that he will attain superannuation on completion of 62 yrs, in derogation of the U.G.C, Notification No.F.3-1/94(PS) dt.24.12.1998 issued by the 2nd respondent is illegal, arbitrary and violative of Articles 14, 21 and 256 of the Constitution of India and consequently direct the respondents to continue the petitioner in service till he attains the age of 62 yrs, in 3rd respondent University as per the Notification No.F.3-1/94(PS) dt.24.12.1998 issued by the 2nd respondent.

When the matter is taken up, learned counsel for the petitioner represents that the cause in the writ petition does not survive.

Recording the said submission the writ petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
