THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 16270 of 2019 ORDER:

This writ petition is filed challenging the action of the 3rd respondent in not taking into consideration of the petitioner's complaint dt.07.02.2019 while conducting investigation in Crime No.311 of 2018 on the file of P.S., Pahadi Shariff, Hyderabad. Learned Assistant Government Pleader for Home produced written instructions submitted by the Sub-Inspector of Police, Pahadishareef P.S., RCK.

To the extent of their relevance to the present writ petition, the said instructions read as under:

" ........the owner/petitioner was examined he stated that he has two drivers namely U.Sanjeeva Kumar and U.Venkatesh, and that his driver U.Venkatesh has informed him that he was driving the vehicle when accident was occurred. Hence the statement of owner/petitioner was recorded. The IO has conducted further enquiries secured the presence of U.Venkatesh and on enquiry he admitted that due to his negligence, the accident was occurred, and the vehicle was burnt. He also stated that he has informed to his owner about the same fact. After conducting further enquiries, on 17.07.2019 the said driver Uppunuthala Venkatesh s/o.Narsayya, age 40 years, R/o.Jillelguda, Saroornagar Mandal, was summoned to the police station and after verifying his driving licence, the undersigned IO issued him a

notice under Section 41-A Cr.P.C and the said U.Venkatesh complied with the notice. A copy of the Notice under Section 41-A Cr.P.C is enclosed for kind perusal."

In the aforesaid instructions since it is stated that the respondent police have issued notice under Section 41-A to Mr.U.Venkatesh, the grievance of the petitioner stood redressed.

Learned counsel for the petitioner states that the writ petition can be disposed of recording the aforesaid instructions. In view of the above, the writ petition is disposed of directing the respondent police to take further steps in accordance with law. No order as to costs.

As a sequel, miscellaneous petitions, if any, pending shall stand closed. No order as to costs.
