HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39101 of 2012 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties the present writ petition is disposed of at the admission stage.
The present writ petition came to be filed seeking to declare the action of the third respondent in not carrying out mutation in the name of the petitioner in respect of lands in Survey No.25/e-2e-10 admeasuring Ac.1.00 guntas situated at Santhamaguluru Village and Mandal, Prakasam District, as illegal and arbitrary and consequently direct the third respondent to mutate the name of the petitioner in the revenue records by considering her representation dated 26.04.2012. Though various grounds are raised by the petitioner, learned counsel for the petitioner restricts his prayer seeking direction to the third respondent to dispose of representation dated 26.04.2012 made by the petitioner seeking mutation of her name in respect of the lands admeasuring Ac.1.00 guntas in Survey No.25/e-2e-10 situated at Santhamaguluru Village and Mandal, Prakasam District at the earliest. Though no counter is filed, learned Government Pleader for revenue submits that the request of the petitioner can be considered, provided the said representation is still pending.
Without going into merits of the case and having regard to the circumstances stated above, the writ petition is disposed of directing the third respondent to consider the representation dated 26.04.2012 made by the petitioner seeking mutation of her name in the revenue records in land admeasuring Ac.1.00 guntas in Survey No.25/e-2e-10 situated at Santhamaguluru Village and Mandal, Prakasam District, in accordance with law, within 12 weeks from the date of receipt of a copy of this order, provided the same is still pending consideration. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
