THE HON'BLE SRI JUSTICE K.C.BHANU CIVIL REVISION PETITION No. 1294 OF 2015 ORDER:

1. The Civil Revision Petition is directed against the Order dated 16.02.2015 in I.A. No.1139 of 2014 in O.S. No.16 of 2014 on the file of the Principal Junior Civil Judge, Mangalagiri, whereunder and whereby petition filed by the respondents/defendants seeking to club the said suit with Original Suit No.39 of 2014, was allowed on the ground that no prejudice would be caused to both the parties.

2. Heard the learned counsel for the petitioner.

3. The only objection taken by the petitioner herein is that the trial in Original Suit No.16 of 2014 has already commenced, whereas in the other suit i.e. O.S. No.39 of 2014, trial has not yet commenced. Original Suit No.16 of 2014 is filed by the petitioner/plaintiff seeking permanent injunction restraining the petitioners/defendants and their men from in any way interfering with and/or causing any obstruction to plaintiff's peaceful control and management of the plaintiff trust over the plaint schedule property, whereas Original Suit No.39 of 2014 is filed claiming right over the management and affairs of the temple in dispute. Since the temple in dispute is common in both the suits, to avoid conflict of decisions, it is desirable to club both the suits, and it causes no prejudice to the case of the petitioner. The trial Court rightly allowed the petition and there are no grounds to interfere with the impugned order.

4. The Civil Revision Petition is, accordingly, dismissed. No costs. Miscellaneous Petitions pending, if any, in the Civil Revision Petition shall stand closed.
