HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.13810 OF 2018 AND WRIT PETITION No.11737 of 2019 COMMON ORDER:

These two writ petitions are being disposed of by way of this common order as the issue raised in these two writ petitions is one and the same.

These writ petitions are filed challenging the award passed by the Industrial Tribunal-cum-Labour Court, Godavarikhani, in I.D.No.43 of 2008 dated 08.03.2013, whereunder the order of removal was set aside and the workman was directed to be reinstated into service with 75% of back wages, however without continuity of service and attendant benefits. W.P.No.13810 of 2018 is filed by TSRTC against granting 75% of backwages, whereas W.P.No.11737 of 2019 is filed by the workman against denial of continuity of service and all attendant benefits.

Counsel appearing for the workman as well as the Standing Counsel appearing for TSRTC have agreed that ends of justice would be met if the award of the Tribunal is modified to the effect that the workman be reinstated into service without back wages, but with continuity of service and all attendant benefits. In view of the above submissions, these writ petitions are disposed of modifying the award of the Tribunal to the effect that the workman be reinstated into service without backwages, but with

continuity of service and all attendant benefits. Rest of the award of the Tribunal is confirmed. No order as to costs. Pending miscellaneous petitions, if any, shall stand closed. ______________________________ ABHINAND KUMAR SHAVILI, J 8th January, 2020 v v
