Heard learned counsel for petitioner.

2) The petitioner/A3 is directed to appear before the trial Court on or before 10.05.2018 and move an application for recall of NBW in which case, the trial Court shall recall the warrant. It is made clear that in view of order of this Court in Crl.P.No.13161 of 2016 dispensing with his attendance in the Court but at the same time directing him to appear before the trial Court when it insists for his appearance for any specific purpose, if the trial Court considers that the presence of A3 is required on forthcoming adjournment, it should clearly mention on the docket that he should present in the Court for the next adjournment and if he fails to attend, accordingly, the Court may follow the due process of law. 3) Criminal Petition is disposed of accordingly. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
