THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.4672 OF 2016 ORDER:

The petitioners claim to be the owners and they have leased out the lands in question to respondents 6 to 13. They allege that the said respondents appear to have obtained an order of legalization of alienation in their favour from the 5th respondent in File No.B/2013/89, dated 04-02-1995. The petitioners state that they have no notice of any such proceeding and the existence of the aforesaid order came to their knowledge when the said respondents produced Certificate under Section 13-B of the A.P.Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act') for claiming compensation. The petitioners' state that based on the said Certificate under Section 13-B of the Act, respondents 1 to 5 are likely to make payment of compensation to respondents 6 to 13.

Hence, immediately on coming to know of the said 13-B order, the petitioners have preferred an appeal along with stay petition on 19-12-2015 before the 4th respondent and the appeal is numbered as A2/11799/115. Alleging that neither the appeal nor the stay petition is being taken up and in the meanwhile, the payment is likely to be made to respondents 6 to 13, the present writ petition is filed.

Heard the learned Government Pleader for Revenue. From the record, it is evident that the petitioners appeal dated 19-12-2015 is pending with the 4th respondent. It is also stated that the stay petition is filed along with appeal and urgent orders are required to be passed.

In view of that, the 4th respondent is directed to fix an early date of hearing preferably within one week from the date of receipt of a copy

of this order, after notice to the parties concerned and hear and decide the stay petition atleast within the time stipulated above. Accordingly, the writ petition is disposed of. No costs.
