THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.4678 of 2018 ORDER:

This criminal petition, under Section 438 of Criminal Procedure Code (for short "Cr.P.C.,"), is filed to enlarge the petitioner/A.1 on bail in the event of his arrest as he is apprehending arrest in connection with Crime No. 38 of 2018 on the file of Kavali-II Town Police Station, SPSR Nellore District. Learned counsel for the petitioner after arguing the matter for awhile, requested this Court to direct the concerned to follow the procedure laid down by the Apex Court in Rajesh Sharma v. State of U.P1.

Acceding to the request of the learned counsel for the petitioner, without touching the merits, the Police of Kavali-II Town Police Station, SPSR Nellore District, are directed to follow the procedure laid by the Apex Court in Rajesh Sharma v. State of UP (referred supra).

With the above direction, this Criminal Petition is disposed of.

Consequently, miscellaneous applications pending if any, shall stand closed.
