HON'BLE SRI JUSTICE U.DURGA PRASAD RAO I.A.No.2 of 2018 in Crl.P.No.4685 of 2018 and Crl.P.No.4685 of 2018 COMMON ORDER:
Criminal Petition No.4685 of 2018 is filed by the petitioners/ A.4 and A.5 seeking to quash the proceedings against them in C.C.No.573/2014 on the file of VI Additional Chief Metropolitan Magistrate, at Hyderabad.
2) On the report given by the defacto complainant, the Police of Tappachabutra PS registered a case in Crime No.206/2009 and after investigation laid charge-sheet against the accused for the offences under Sections 324, 326, 506 r/w 34 IPC and charge sheet was taken cognizance and registered as C.C.No.573 of 2014 and pending on the file of VI Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.
3) The charge-sheet allegations in brief are that on 02.12.2009, the complainant received a phone call from his sister-in-law-Smt. Asra Begum, that her son-in-law-Yousuf, was quarrelling with his wife and so he rushed to his sister-in-law's house at Talim Amlapur and found that they were quarreling. The defacto complainant interfered and pacified the matter. In the meanwhile, A.1 and A.2 abused them and alleged that they are creating nuisance in the locality and with the help of other accused, attacked them with
sticks. Due to which the complainant sustained fracture to his right hand and injuries on other parts of the body and his cousin-Abuzer sustained minor injuries during scuffle.
4) While-so the defacto complainant and A.4 and A.5 filed I.A.No.1 of 2018 seeking permission of this Court to compound the offences. By a separate order dated 01.05.2018, this Court granted permission for compounding the offence.
5) Today, parties are present and they are identified by their respective counsel.
6) On enquiry by this Court, the defacto complainant affirmed the contents of the joint memo and submitted that he has no objection for quashing the proceedings against the petitioners. 7) In that view of the matter and as the parties have amicably resolved their disputes at the intervention of elders and the allegations made in the charge sheet will have no repercussion on the society and also following the decision reported in Gian Singh v. State of Punjab and another1, I.A.No.2 of 2018 is allowed and permission is accorded to the parties to compromise the matter and consequently, Crl.P.No.4685 of 2018 is allowed and the proceedings in C.C.No.573 of 2014 on the file of VI Additional Chief Metropolitan Magistrate at Hyderabad are quashed against the petitioners/A.4 and A.5 only and they are acquitted of the offences 1 (2012) 10 SCC 303
for which they have been charged. It is made clear that the proceedings against other accused will continue. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
