O R D E R
The grievance of the petitioner is as to the opening and maintenance of a rowdy sheet in his name on the file of the I Town Police Station, Srikalahasti, Chittoor District.
Though the Sub Divisional Police Officer, Srikalahasti Sub Division, Tirupati Urban District, filed a counter affidavit seeking to justify this action, perusal thereof reflects that not even a single case was registered against the petitioner.
Mentioning of Crime No.76 of 2011 on the file of Srikalahasti II Town Police Station is of no avail, as the petitioner claims that he was the complainant therein and not the accused. Thus, the petitioner is not shown to be involved in any criminal case warranting the opening of a rowdy sheet in his name or its continuance thereafter. Such an action on the part of the police authorities is also in utter violation of the law laid down by this Court in K. Suresh Babu v. Superintendent of Police, Anantapur Dist.[1] following the earlier decisions in Kamma Bapuji v. Station House Officer, Brahmasamudram[2] and Puttagunta Pasi v. Commissioner of Police, Vijayawada[3].
The writ petition is accordingly allowed. The respondent police authorities shall forthwith close the rowdy sheet opened and being maintained in the name of the petitioner on the file of the I Town Police Station, Srikalahasti, Chittoor District. This order shall however not preclude the police authorities from taking action afresh in accordance with law, if warranted.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ SANJAY KUMAR, J Date: 19.04.2016
