The petitioner/accused No.5 filed the present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS), seeking to grant pre-arrest bail to him in Crime No.27 of 2026 of Economic Offences Wing (EOW), Cyberabad Police Station, Cyberabad Commissionerate which was registered for the offence punishable under Sections 318(4), 316(2) of the Bharatiya Nyaya Sanhita 2023 (BNS) and Section 5 of the Telangana Protection of Depositors of Financial Establishments Act, 1999.

Heard Mr. Sanjeev Reddy Garlapati, learned counsel for the petitioner and Mr. M.Vivekananda Reddy, learned Assistant Public Prosecutor appearing for the respondent-State. 3.
The brief facts of the case are that on 26.03.2026 the de facto complainant lodged a report before Police stating that A1 to A5 started investment scheme to sell plots on payment of amount on instalment basis. They also established a company by name, "Subhakshetra Projects Private Limited", and claimed to develop 16 Acres DTCP approved venture by name "Subhakshetra" situated at Damarigada Village, Nyalkal Mandal, Sanga Reddy District. Accordingly, the de facto complainant paid an amount of Rs.5,00,000/- to A1 on 05.09.2025. Along with de facto complainant other members also registered for the said scheme and paid regular instalments. Apart from Subhakshetra projects, accused also collected amount through bank transfers to Gokul Nandana Infrastructure Private Limited. Altogether, they cheated approximately Rs.6,58,50,000/-. Hence, he requested to take action against the accused.

Learned counsel for the petitioner submitted that the allegations is that the brother of petitioner, accused No.1 and others collected certain amounts under investment scheme on the name of company called "Subhakshetra Projects Private Limited", where, accused No.1 is the Managing Director. Petitioner neither induced the people to invest nor collected deposits in the name of investment scheme. Though, deposits were collected under the name of "Subhakshetra Projects Private Limited", the company of petitioner i.e., Gokul Nandana Infrastructure Private Limited was falsely implicated in this case. The name of the petitioner was nominally mentioned as Director for the purpose of registering the company and she is not at all involved in day to day activities of the company. Further, accused No.1, who is Managing Director was arrested on 16.04.
2026. Learned counsel further submitted that the petitioner is lactating mother with five (5) months old baby. Petitioner is ready to cooperate with investigation, if required. As the petitioner apprehends arrest, she prays this Court to grant prearrest bail.

On the other hand, learned Assistant Public Prosecutor opposed the submissions made by the learned counsel for the petitioner and stated that the petitioner is one of the Directors of the Gokul Nandana Infrastructure Private Limited which collected amounts from the depositors, and investigation is not yet completed and the allegations levelled against the petitioner are serious in nature. Therefore, at this stage, granting of pre-arrest bail to the petitioner does not arise. Hence, he prayed the Court to dismiss the criminal petition 6.
In view of the facts and circumstances of the case, taking into consideration that the petitioner is not involved in day to day activities of the company, and that she is a lactating mother with five (5) months old baby; this Court deems it fit to grant anticipatory bail to the petitioner/accused.

Accordingly, this Criminal Petition is allowed and the petitioner/accused No.5 shall be released on anticipatory bail on the following terms and conditions:
i.
The petitioner shall surrender before the Station House Officer, Economic Offences Wing (EOW), Cyberabad Police Station, Cyberabad Commissionerate, within two (2)
weeks from today and on such surrender, the said Station House Officer shall release her on bail on her executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m. and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
