HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37175 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to declare the action of respondents Nos.4 to 6 in threatening him to appear before them and to settle the matter with the complainant in FIR No.147 of 2016.

Heard and perused the material available on record. 3.
It is stated in the affidavit that one D. Laxmi filed a private complaint alleging that Smt. Kolmi Sanjana and seven others fabricated documents in respect of the subject property and cheated her. The said private complaint was referred to the police and hence, the police registered the above crime. While so, respondents Nos.5 and 6 are compelling the petitioner to settle the matter. Therefore, the petitioner apprehends arrest.

The petitioner filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation. However, taking into consideration the circumstances of the case, this Court is of the view that the investigation can be completed without arresting the petitioner.

Accordingly, respondents Nos.2 to 6 are directed to complete the investigation and file a final report in the above Crime, in accordance with law, without arresting the petitioner.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
