THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26160 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.366 of Lenin Nagar, Saroornagar Mandal, Ranga Reddy District. While so, on 28.07.2015, the Assistant Supply Officer, Circle-III, Saroornagar inspected the shop of the petitioner and noticed some variations. In respect of the said variations, 6-A proceedings were initiated and they are pending. Based on the report of the said officer dated 29.07.2015, a show cause notice was issued to the petitioner on 04.08.2015 and the authorization of the petitioner was suspended. Challenging the same, the present writ petition is filed.

3. The third respondent should have seen that the proceedings before the second respondent are different from the proceedings before him and he should have conducted an independent enquiry in respect of the allegations leveled against the petitioner pursuant to the show cause notice dated 04.08.2015.

4. In the circumstances, the writ petition is disposed of directing the third respondent to conduct an enquiry in respect of the allegations leveled against the petitioner and complete the same, within a period of 60 days from the date of receipt of a copy of this order, by giving due opportunity to the petitioner.
