HON'BLE SRI JUSTICE R. SUBHASH REDDY CIVIL REVISION PETITION No.1425 of 2015 ORDER :
This civil revision petition is filed under Article 227 of the Constitution of India, by the respondents in O.P.No.1836 of 2014, aggrieved by order dated 21.08.2014, passed in I.A.No.537 of 2014 by the XIII Additional Chief Judge, City Civil Court, Hyderabad. The dispute is with regard to conduct of elections to the managing committee of the 1st petitioner-Society. Along with the O.P., respondents herein have filed I.A.No.537 of 2014 under Order 39 Rules 1 and 2 of CPC, to restrain the respondents in the O.P. from conducting elections to the State Executive Body of the Society on 24.08.2014. By impugned order dated 21.08.2014, directions are issued to the respondents therein to deposit the box containing votes with the Registrar of Societies, until further orders. In this petition, it is the grievance of petitioners that inspite of filing counter, the said interim orders are continued and no further orders are passed. It is further submitted that another application in I.A.No.675 of 2014 is filed by the petitioners herein for declaration of results, and the same is also pending.
Having passed orders on 21.08.2014 for depositing the box containing votes with the Registrar of Societies until further orders, there appears no reason for not passing further orders by the trial Court. Further, there is also no reason for not disposing of I.A.No.675 of 2014 filed by the petitioners for declaration of results. For the aforesaid reasons, I deem it appropriate to dispose of this revision petition with a direction to the learned XIII Additional Chief Judge, City Civil Court, Hyderabad, to dispose of I.A.Nos.537 and 675 of 2014, as expeditiously as possible, preferably within a
period of six weeks from today, by hearing both sides. Subject to above directions, this revision petition is disposed of. No order as to costs.
