JUSTICE JUVVADI SRIDEVI FAMILY COURT APPEAL No.49 OF 2017 JUDGMENT: (Per the Hon'ble Dr.SA,J) This Family Court Appeal, under Section 19 of the Family Courts Act, 1984, is filed by the appellant/wife, aggrieved by the order and decree, dated 30.01.2016 passed in F.C.O.P.No.1359 of 2013 by the learned Judge, Family Court, Hyderabad, whereby the petition filed by the respondent/husband under Section 13(1)(ia) & (ib) of the Hindu Marriage Act seeking dissolution of marriage between the appellant/wife and the respondent/husband, which was solemnised on 05.11.2003. 2.

Heard Sri P.Amarender Reddy, learned counsel for the respondent and perused the record.

No representation for the appellant.

Both the appellant and the respondent are present and they are identified by the learned counsel for the respondent. 5.

Both the parties have filed a joint memo stating that at the intervention of the elders and the well wishers, they have amicably settled their differences and living together along with

their minor daughter, by name, Ashritha, aged 16 years. They requested this Court to set aside the impugned order and decree, dated 30.01.2016, passed in F.C.O.P.No.1359 of 2013 by the learned Judge, Family Court, Hyderabad. 6.

Since both the parties are living together, as they have compromised the subject matter and a memo is filed to that effect, the impugned order and decree, dated 30.01.2016, are liable to be set aside.

Accordingly, the Family Court Appeal is allowed setting aside the impugned order and decree, dated 30.01.2016 passed in F.C.O.P.No.1359 of 2013 by the learned Judge, Family Court, Hyderabad.

Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
