HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE DR JUSTICE SHAMEEM AKTHER W.P. No. 23452 of 2017 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed seeking to quash the order dated 16.02.2017 in M.A.No. 137 of 2017 in O.A.(SR).No. 740 of 2017 passed by the Tribunal.
We note, vide the aforesaid M.A., the petitionerassociation sought to file an Original Application and consequently sought permission to file the same as Association. We further note that the relief sought in the proposed O.A. is that respondent Nos.3 to 15 are imposing sentry duties to the Driver Operators in contravention of Order No. 512 of A.P. Fire Services Manual as well as Circulars issued from time to time including Memo No. 84032/ PRI-A/ 952, dated 26.02.1996. The Tribunal, by the impugned order dated 16.02.2017, observed that in case such sentry duties are given contrary to Rules and Circulars to any Driver Operator, it is for the said individual to agitate the same before the competent authority or the Tribunal. As per settled law, the general cause of action for the Association to espouse the matter on behalf of the members is not permissible under law.
SKK,J & Dr.SA,J WP_23452_2017 In view of the observations recorded as above, we find no illegality or perversity in the impugned order passed by the Tribunal.
Hence, the writ petition is devoid of merit, and the same is accordingly dismissed. No order as to costs. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
