HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10716 of 2015 ORDER:

This application is preferred by the petitioner - A1, under Section 438 Cr.P.C., seeking to grant anticipatory bail in C.C. No.295 of 2015 (Crime No.448 of 2011 on the file of WPS, CCS, Hyderabad) on the file of XIII Chief Metropolitan Magistrate, Hyderabad.

The offences alleged against the petitioner are under Sections 498(A), 406 read with 34 I.P.C. and Sections 4 & 6 of Dowry Prohibition Act. After completion of investigation, charge sheet has already been filed and the trial Court has taken cognizance of the said charge-sheet. As the petitioner was shown as absconding, the Court below has issued NBW against him.

Considering the facts and circumstances of the case, the petitioner-A1 is directed to surrender before the Magistrate concerned and file a petition to recall the N.B.Ws. issued against him. Upon filing of such petition, the Magistrate concerned is directed to recall the warrant, pending against the petitioner, on the same day on his executing a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with one surety for a like sum to the satisfaction of the said Magistrate. Further the petitioner is directed to appear before the trial Court regularly either by person or through his Advocate.

Accordingly, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed. ______________ RAJA ELANGO, J October 30, 2015 KTL
