THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.30150 of 2015 ORDER:
Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.
2. The petitioner was appointed as a fair price shop dealer of shop No.56, Melavoy-2 Village, Madakasira Mandal, Prakasam District. While so, the fourth respondent submitted a report on 24.01.2015 stating that on 23.01.2015 at about 3.00 am., ASI, Madakasira and his staff seized 200 liters of kerosene oil from one Maruthi Omni vehicle with registration No.AP02C 1655 coming from Melavoy Cross, Melavoy Village, for illegal transportation. Based on the said report, the third respondent issued a show cause notice to the petitioner on 04.02.2015 and the petitioner submitted his explanation on 09.02.2015.
After receipt of the explanation, the third respondent passed an order on 23.02.2015 cancelling the authorization of the petitioner. Against the same, the petitioner preferred an appeal to the second respondent, who confirmed the order passed by the third respondent, by his order dated 10.08.2015. Challenging the said order, the present writ petition is filed.
3. This Court is not inclined to interfere with the present writ petition as there is an alternative remedy of revision to the District Collector, Prakasam at Ongole.
4. In view of the same, the writ petition is disposed of giving liberty to the petitioner to avail the remedy of revision before the competent authority within 15 days from the date of receipt of a copy of this order. No order as to costs. Miscellaneous petitions, if any pending, shall stand closed.
