Heard learned counsel for the respondents.

By this Habeas Corpus writ petition the petitioner seeks production of one Mohammed Imran Hussain, s/o. Saber Hussain alleging that he has been illegally detained by respondent No.2.

Learned counsel for the respondents submits that, as a matter of fact, Mohammed Imran Hussain has been arrested as Accused No.2 in connection with Crime No.315 of 2015 registered at Rajiv Gandhi International Airport Police Station on 07.11.2015 and presently he is in judicial custody. That seems to be the reason why no one is coming forward to work out this petition on merits.

Hence, we are constrained to dismiss the writ petition for non-prosecution. Order accordingly.
