Heard learned counsel for the petitioner, learned Government Pleader for Civil Supplies and Sri T.Srinivas, learned counsel, for the respondents.
By way of an order, vide proceedings in Rc.D1.93/2017, dated 18.11.2017, the Joint Collector, Chittoor District-second respondent herein ordered cancellation of Form-B licence bearing No.73/TPT/2004 issued in favour of M/s Siva Pavani Filling Station at Sy.No.254/2, M.R.Palli Road, Tirupathi. Aggrieved by the said order of cancellation, the petitioner herein filed Appeal No.350/17 before the Commissioner of Civil Supplies-fifth respondent herein on 02.12.2017. The grievance of the petitioner in the present Writ Petition is that, despite lapse of considerable length of time, the fifth respondent herein is not passing any orders on the said appeal and, in view of the said inaction, the petitioner herein is sustaining irreparable loss and hardship and is not in a position to distribute the stock supplied by the third respondent.
Having heard the learned counsel for the petitioner, the learned Government Pleader and the learned Standing Counsel and as the statutory appeal is pending consideration before the fifth respondent since 02.12.2017, this Court deems it
appropriate to dispose of the Writ Petition with a direction to the fifth respondent to pass appropriate orders on the appeal, dated 02.12.2017, as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any pending, in this Writ Petition, shall stand closed. __________________ A.V.SESHA SAI,J 19th April, 2018 Tsy
