HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR C.R.P.No.5818 of 2015 AND C.R.P.NO.5819 OF 2015 COMMON ORDER:

Heard.

The present civil revision petitions are preferred against the dismissal order passed in I.A.Nos.957 and 958 of 2015 in O.S.No.132 of 2007 by the Additional Senior Civil Judge, Chittoor, to reopen the suit and to sent the suit agreement to expert's opinion, on the reasons of delay as well as merits.

Learned counsel for the respondent submitted that the arguments of the petitioner/plaintiff were concluded in the suit before the Court below.

A perusal of the impugned orders show that the opinion of the expert is already available and the petitioner had cross examined the expert as DW.3 and that at the fag end of the suit, the present applications are filed. Therefore, I do not see any bonafides on the part of the petitioner as is evident from the circumstances as set out from the orders of the Court below. Hence, no interference with the impugned orders is called for, at this stage.

Accordingly, the civil revision petitions are dismissed. Miscellaneous petitions, if any, pending in this revision petition shall stand closed. There shall be no order as to costs. ___________________________ VILAS V.AFZULPURKAR, J Date: 06-01-2016 Kvrm HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR
