SUNIL CHOWDARY WRIT PETITION No.7199 of 2016 ORDER: (Per Justice Sanjay Kumar) The grievance of the petitioner in this case is with regard to the order dated 15.02.2016 passed by the Telangana State Consumer Disputes Redressal Commission in CCIA.No.285 of 2016 in CC.No.30 of 2016.
It is however stated by Sri N. Ashwani Kumar, learned counsel for the petitioner, that a counter-affidavit was filed by his client before the Commission along with a petition to vacate the afore-stated order dated 15.02.2016. Learned counsel would submit that the said petition along with the supporting affidavit is yet to be considered by the Commission.
As the Commission is already seized of the matter and is yet to apply its mind to the petition filed to vacate the order dated 15.02.2016, this Court sees no reason to entertain this writ petition and adjudicate upon the validity of the said order. As the vacate stay petition is pending consideration before the Commission, expeditious consideration of the same by the Commission would serve the interests of justice adequately.
The writ petition is accordingly closed. We hope and trust that the Commission would take up the petition filed in CCIA.No.285 of 2016 in CC.No.30 of 2016 to vacate the order dated 15.02.2016 expeditiously and dispose of the same on merits and in accordance with law.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
