HON'BLE SRI JUSTICE R. SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA W.P.No.16081 OF 2015 ORDER: (Per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed by the petitioner with the prayer, which reads as under:
"to issue a writ, or order, or direction one in the nature of writ of mandamus declaring that action of the respondent Nos.3 and in collecting Rs.2,40,979.76ps from late Smt Indira towards insurance premium (single payment) for the period covering from 27.12.2012 to 26.12.2019 under Master Police No.G0000002 vide loan account No.146730100011225 sum assured is Rs.29,15,000/- is illegal, as the respondents put pressure on the petitioner under Section 13(2) of Act 54 of 2002 for Enforcement of Security Interest pending claim of the petitioner before respondent Nos.3 and 4 is unlawful, arbitrary, and violation of law and procedure and to direct respondent No.4 to clear the loan under the policy for an extent of Rs.29,15,000/- forthwith and in case any balance amount falls due the petitioner may be directed to pay the same to respondent No.3 herein."
When the matter is called, it is represented that during pendency of the writ petition, dispute between the petitioner and the 4th respondent is settled and respondent No.4/Insurance Company has agreed to pay a sum of Rs.20,00,000/- (Rupees twenty lakhs only) and
entered into Memorandum of Settlement with the petitioner to that effect.
The said Memorandum of Settlement is filed before the Court vide U.S.R.No.19305, dated 01.09.2015, and the parties have requested to dispose of the writ petition in terms of the compromise. In view of the request made by the learned counsel for the parties, the writ petition is disposed of in terms of the Memorandum of Settlement. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
