HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6572 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/Accused No.1 under Section 482 Cr.P.C seeking to quash the proceedings in C.C. No.274 of 2013 on the file of the XV Additional Chief Metropolitan Magistrate, Hyderabad which is the outcome of Crime No.164 of 2012 registered for the offences punishable under Sections 498-A read with 34 I.P.C and Sections 3 and 4 of the Dowry Prohibition Act.

2) Admittedly Accused Nos.2 and 3 are parents of the petitioner herein, stated already filed Crl.P.No.13219 of 2013 for similar prayer which is pending in another Court and the petitioner/A-1 is no other than the husband of the defactocomplainant/2nd respondent. The defacto-complainant present and the 1st accused absence stating that he is at Middlesex London, United Kingdom and the parents present to seek for compounding the offence. This Court raised objection thereby rectified the same by filing an affidavit of the 1st accused with supporting affidavit of A-2 and A-3. The common affidavit filed by parents stating that the A-1 and the defacto-complainant want to live together by drowning their differences as already settled through elders and the criminal case is coming in the way to the defacto-complainant, thereby the defacto-complainant sought direction to compound.

3) Accordingly, the Criminal Petition is allowed and all the

proceedings relating to C.C. No.274 of 2013 on the file of XV Additional Chief Metropolitan Magistrate, Hyderabad are quashed. The bail bonds of the petitioners, if any, shall stand cancelled.

4) Miscellaneous petitions, if any pending, shall stand closed.
