.IION'BLE JUSTICE G. SRI DEVI TSRIMINAL PETITION No.46O8 of 2Ol9 ORDER:
This Criminal Petition under Section 43U of Cr.P.C. is filed by the petitioner, who is sole Accused, seeking anticipatory bail in PCOR No.64 of 2015 of Prohibition and Excise Police Station, Wanaparthy, Mahabubnagar District, registered for the offences punishable under Sections 34(a) of the A.P. Excise Act, 1968 and Section 8(c) r/w. Section 22(c) ofNDPS Act, 1985 The case of the prosecution is that the Excise Police registered the above case against the petitioner/Accused stating that the toddy collected from her toddy shop was found adulterated with Alprazolam.
Heard learned counsel for the petitioner,/Accused and the learned Aclditional Public Prosecutor appearing for the respondent-State. Perused the material on record. Learned counsel for the petitioner contends that the petitioner is innocent of the alleged offences and she is no way connected with the above crime as she is only an employee of the said toddy shop and she has been falsely \ implicated in the above crime. It is further contended that investigation has already been completed, except filing of charge sheet. It is contended that the petitioner is ready to abide by any of the conditions imposed by this Court and !
GSD, J Crl.P.No.4608 of 2019 would cooperate with the investigation, if she is released on anticipatory bail in the event of her arrest in connection with the aforesaid crime On the other hand, the learned Additional Public Prosecutor opposed the relief sought in the above petition. Keeping in view the facts and circumstances of the case, since no specific allegations are made against the petitioner, I arn inclined to grant anticipatory bail to the petitioner/Accused by imposing some conditions. In the result, this criminal petition is allowed and the petitioner/Accused is directed to be released on bail in the event of her arrest in connection with PCOR No.64 of 2015 of Prohibition and Excise Police Station, Wanaparthy, Mahabubnagar District, on her executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two local sureties for a like sum each to the satisfaction of the said Station House Officer and subject to the condition that the petitioner would cooperate with the investigation Agency. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
