THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NOS.29589 AND 30443 OF 2012 C O M M O N O R D E R These writ petitions were filed by a driver and a conductor working in the Andhra Pradesh State Road Transport Corporation (APSRTC). They were both subjected to orders of suspension in relation to the same incident. Interim orders were passed in both the writ petitions directing the APSRTC to permit the petitioners to discharge their duties by suspending the orders dated 05.09.2012 whereby they were placed under suspension.

Though vacate stay petitions were filed by the APSRTC in both the writ petitions, Sri Mayur Reddy, learned standing counsel for the APSRTC, stated before the Court that enquiries against the petitioners in these two cases had been concluded, but being under the impression that pendency of these writ petitions would bar it from passing final orders, the APSRTC has not proceeded in the matter. Taking note of the above submission, the writ petitions are disposed of with the following order.

As the suspension orders dated 05.09.2012 impugned in the two writ petitions were not given effect till date by virtue of the interim orders and as the disciplinary enquiries initiated against the petitioners are stated to have concluded, there is no necessity to now give effect to the impugned suspension orders at this stage and the same are accordingly set aside. It shall be open to the APSRTC to pass final orders in the pending disciplinary proceedings initiated against both the petitioners in accordance with law. The writ petitioners shall be at liberty to avail suitable remedies in accordance with law if they are aggrieved by such

final orders. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ______________________ SANJAY KUMAR, J 20th MARCH, 2015 Svv
