ORDER:

This contempt case is filed alleging willful disobedience of order, dated 18.12.2014, in W.P.No.26406 of 2014. 2.

The respondents are personally present. Mr.Shashi Bhushan Kumar, I.A.S., - respondent No.1 has placed before the Court, copy of G.O.Rt.No.580, Water Resources (Projects.I) Department, dated 16.08.2018, and submitted that as petitioner No.2 was dismissed from service, the order could not be implemented in respect of the said petitioner. The learned counsel for the petitioners, therefore, did not press the contempt case qua the said petitioner.

As regards petitioner No.1, respondent No.1 has stated that though respondent No.2 estimated the present market value at Rs.4,800/- per sq. yard., in obedience to order, dated 18.12.2014, in W.P.No.26406 of 2014, the Government issued G.O.Rt.No.580, dated 16.08.2018, agreeing to sell quarter No.28-2, covering land to an extent of 200.66 sq. yards. including building, situated in Belagam, Parvathipuram Mandal, Vizianagaram District, on a nominal cost as per G.O.Ms.No.61, Irrigation & Command Area Development (PW-NSP.I) Department. Dated 03.07.2004. As it is not elucidated in the

said G.O., as to the price of the quarter, on a query from the Court, respondent No.1 has candidly stated that the nominal cost is only Rs.200/- of the entire quarter as per G.O.Ms.No.61, dated 03.07.2004, and that petitioner No.1 is entitled to registration of the aforesaid quarter on payment of Rs.480/- only i.e., nominal cost of Rs.200/- + escalation charges @ 10% per annum for 14 years.

In the light of the above statement of respondent No.1, which is placed on record, the Contempt Case is closed with the direction that respondent No.2, who is personally present in the Court, shall complete the registration process within two months of petitioner No.1 paying Rs.480/- and registration charges.

As a sequel to closure of the contempt case, Application No.189 of 2017 and I.A.Nos.1 and 2 of 2018 stand dismissed as infructuous.
