Sri K.V. Bhanu Prasad, learned counsel appearing for the appellant, addressed letter dated 28.10.2015 to the Registry stating that his client instructed him to withdraw the appeal with liberty to file a fresh appeal against the same decree and judgment, in case of necessity.

The appeal is accordingly dismissed as withdrawn with liberty as sought for. No order as to costs. The miscellaneous petitions pending, if any, shall stand closed.
