THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No.1694 of 2015 ORDER:
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue (AP), for respondents. The grievance of the petitioners is that against the order dated 22.10.2014 passed by the 3rd respondent an appeal has been preferred to the 2nd respondent on 29.11.2014. Along with the appeal, the petitioners also moved an application seeking stay of order dated 22.10.2014.
The contention of the petitioners is that the very order dated 22.10.2014 was passed without issuance of notice and without conducting any enquiry whatsoever, so far as the petitioners are concerned.
Learned Assistant Government Pleader opposed grant of any order contending that the petitioners failed to give any details with regard to the appeal and the appeal number etc. Having considered rival contentions, the prayer in the writ petition being limited complaining with respect to in action on the part of the 2nd respondent in not passing orders, the writ petition can be disposed of with a direction to the 2nd respondent to take up the appeal and pass appropriate orders in accordance with law after considering the contentions of respective parties. In as much as the patta has been granted to the petitioners on 06.02.2001, the petitioners shall not be dispossessed until passing of the final orders in the appeal by the 2nd respondent.
With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
The miscellaneous petitions filed in this writ petition shall also stand disposed of.
