This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/accused Nos.1 & 2 seeking enlargement on bail in connection with Crime No.250 of 2026 of Kushaiguda Police Station, Malkajgiri District. The offences alleged against the petitioners are under Sections 118(1), 115(2), 352 read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 (BNS).

The brief facts of the case are that, on 30.03.2026, the de-facto complainant lodged a report with the police wherein he stated that his father went on his two-wheeler and parked the same on the road in front of Reliance Digital near Radhika X Roads. At that time, two persons who had already parked two-wheeler were trying to remove their vehicle and started speaking rashly with his father stating that he did not stop at all. His father replied that there was sufficient space to move the vehicle. Suddenly, both the accused persons kicked his father, resulting in his father along with the vehicle falling down on the road. Later, the accused abused his father in a filthy language and punched him repeatedly on his face. As a result of which, his father sustained bleeding injury.
The said incident was informed to the de-facto complainant by passersby. The de-facto immediately shifted his father to hospital for treatment. As such, he requested the police to take necessary action against the accused persons. Based on the said complaint, the police registered a case in Cr.No.250 of 2006 for the offences stated above and took up investigation. 3.

The contention of learned counsel for the petitioner is that the petitioners are innocent of the alleged offences and that, without there being any prima facie evidence against the petitioners, they were falsely implicated in the case. He further submitted that the petitioners have committed the said incident at the spur of the moment and they are in jail since 10.04.2026. He also submitted that major part of investigation is completed. Therefore, he prayed this Court to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor submitted that the allegations against the petitioners were severe in nature. He also submitted that investigation is completed and charge sheet is also filed. 6.
In light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it is evident that the petitioners have been in judicial custody since 10.04.2026 and also in view of the fact that the investigation is completed and charge sheet is also filed, this
- 4 - Court finds it appropriate to grant bail to the petitionersaccused Nos.1 & 2, subject to the following conditions: i.
The petitioners-accused Nos.1 and 2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned II-Additional District and Sessions Judge, MedchalMalkajgiri District at Kushaiguda. ii.
The petitioner-accused Nos.1 & 2 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).
iii.
The petitioners-accused Nos.1 & 2 shall appear before the trial Court on every date of hearing till the disposal of the case.

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
