THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.726 of 2009 JUDGMENT:

This appeal is filed by the defendant, under Section 100 CPC, assailing the judgment and decree dated 13.06.2002 in A.S.No.66 of 1999 on the file of III Additional District Court, Anantapur, wherein whereby the decree and judgment dated 27.08.1999 passed in O.S.No.312 of 1991 on the file of Principal Junior Civil Judge Court, Anantapur, decreeing the suit filed by the plaintiff for partition and separate possession, was reversed. 2.

At the time of hearing, learned counsel for the appellant seeks permission of this Court to permit the appellant to withdraw the appeal. To that effect, he also filed a letter in the Registry.

Permission as sought for is accorded.
