THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE MRS. JUSTICE ANIS WRIT PETITION No.33591 of 2015 ORDER: (Per Hon'ble Sri Justice Nooty Ramamohana Rao) Against an interim order passed by the Tribunal, this writ petition is preferred by the Agricultural Market Committee, Cheepurupalli, Vizianagaram District. The relief granted by the Tribunal is stay of further action of lodging a criminal complaint against the applicant before the Station House Officer, Cheepurupalli. We consider that the present writ petition is an abuse of the process of the Court. If, lodging the criminal complaint is stayed pending further consideration of the O.A and if there is sincere urgency in the matter to have the case resolved, the Agricultural Market Committee should have impressed the Tribunal to take up the matter on out of turn basis.
in case the period of limitation for taking criminal action is running out then the Andhra Pradesh Administrative Tribunal would take up the main case on out of turn basis and decide it on merits. Hence, this writ petition is dismissed at the admission stage. The Agricultural Market Committee, Vizianagaram District, the petitioner is directed to pay Rs.1,000/- (Rupees One Thousand Only) as compensatory costs to the District Legal Services Authority, Vizianagaram District, and produce the necessary receipt. 15 days time is granted to pay the compensatory costs.
Consequently, miscellaneous applications pending if any, shall also stand dismissed. No costs.
