HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7481 of 2017 ORDER :

Heard learned counsel for the petitioners/ A1 to A3 of Crime No.111 of 2017 dated 17.07.2017 on the file of the Mummidivaram Police Station, East Godavari District, registered on the report of the 2nd respondent/ de facto complainant, for the offences punishable under Sections 447, 427 and 506 r/ w 34 I.P.C. and perused the grounds urged in the quash petition and other material on record. It is one of the contentions that the so called de facto complainant never in possession of the property and in fact, the accused are in possession of the same and a false case is foisted against them. A perusal of the material on record discloses that the contentions raised by the learned counsel for the petitioners have to be investigated and it is premature for this Court to interdict the investigation. Having regard to the above, the Criminal Petition is disposed of directing the Police, not to arrest the petitioners/ A1 to A3 pending investigation. However, this order will not prevent the Police to secure the petitioners/ A1 to A3 for the purpose of investigation, as and when required.

Consequently, miscellaneous petitions, if any, pending shall stand closed.
