This petition is filed, under Sections 437 and 439 of the Code of Criminal Procedure, for grant of bail to the petitioneraccused in Crime No. 881 of 2017 of Saroor Nagar Police Station, Rachakonda, registered for the offences punishable under Section 366 of IPC and Section 3 read with Section 4 of POCSO Act.

Heard learned counsel for the petitioner and learned Public Prosecutor (T.S.).

The case of the prosecution in brief is that on 10-12-2017 at 7.00 hours, as usual, the de facto complainant went to attend her cooking work and at that time, her daughter and mother were present in the house; that when she returned back at about 14.00 hours, her daughter Kumari Navsheen, aged 17 years, was found missing; that on enquiring about her daughter, her mother informed her that at about 10.00 hours, Navsheen went to shop but did not return to home; that immediately, the de facto complainant searched about her daughter in and around but could not get any information and that immediately, she opened the almirah and found that an amount of Rs.25,000/ - was missing.

Learned counsel for the petitioner submits that the petitioner is falsely implicated in the present case and he has nothing to do with the offence and that he has been languishing in jail since 05-03-2018.

Learned Public Prosecutor has opposed the petition on the ground that investigation is not completed yet. 6.
The material collected during investigation discloses that the petitioner abducted the minor child with intent to marry her which prima facie constitutes the offences punishable under Section 366 of IPC and Section 3 read with Section 4 of POCSO Act.

Taking into consideration the stage of investigation and the gravity and nature of the offences, I find that it is not a fit case to enlarge the petitioner on bail.

The criminal petition is accordingly dismissed. Pending miscellaneous petitions if any shall stand dismissed in consequence.
