THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 16426 of 2019 ORDER:

This writ petition is filed challenging the action of the 2nd respondent in calling the petitioner to the police station in relation to Crime No.138 of 2019, though the petitioner is no way concerned with the said case.

Learned Assistant Government Pleader for Home produced written instructions dt.01.08.2019 submitted by the Head Constable, LMD Colony P.S., Karimnagar District, stating that a case was registered in Crime No.138 of 2019, under Sections 341, 324, and 506 read with 34 IPC, on the file of LMD Colony Police Station on 26.02.2019, against K.Ravi and others; that during the course of investigation as per evidence collected, it was established that the petitioner was involved in the said offence, and as such his name is arrayed as Accused No.2 in the said case.

Recording the aforesaid submissions of learned Assistant Government Pleader, the writ petition is disposed of granting liberty to the petitioner to avail alternate remedy as may be available to him under law, in respect of registration of crime against him. But, learned counsel for petitioner states that respondents have to follow procedure as laid down in Arnesh Kumar v. State of Bihar

and another (2014) 8 supreme Court cases 273. In view of the same, the respondent police have to follow due procedure as laid down by the Apex Court in Arnesh Kumar's case. No order as to costs.

As a sequel, miscellaneous applications, if any, pending shall stand closed. No order as to costs.
