Heard Sri R.N. Hemendranath Reddy, learned counsel appearing for the petitioners, Dr. P.B. Vijay Kumar, learned counsel appearing for the 3rd respondent and the learned Government Pleader for Cooperation appearing for the respondents 1, 2 and 4 to 6.
2. This writ petition is filed against an interlocutory order passed by the Telangana Cooperative Tribunal, Warangal, ex parte. The petitioner can as well move the
Cooperative Tribunal and get the interlocutory application adjudicated on merits. However, it is submitted on behalf of the petitioners that the petitioners were not parties in the appeal before the Cooperative Tribunal. Therefore, the adjudication of the interlocutory application before the Cooperative Tribunal is liable to be delayed.
3. Under these circumstances, the writ petition is disposed of with a direction to the petitioner to approach the Cooperative Tribunal by making an application for impleadment and on such application being made, the Cooperative Tribunal is directed to dispose of the implead petition as well as the interlocutory application on merits as expeditiously as possible within a period of 15 days from the date of receipt of a copy of this order. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
