THE HONOURABLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No.6822 of 2025 ORDER:
This Criminal Petition is filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short 'BNSS') seeking bail to the petitioner/accused in Crime No.412 of 2025 on the file of Basheerabad Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 69 and 109 of the Bharatiya Nyaya Sanhitha, 2023 (for short 'BNS').

The case of the prosecution is that on 10.03.2025, the de facto complainant filed a complaint stating that his sister Miss. K. Priyanka, who is working in the purchase department of Dicel Pharma, Shamirpet, fell in love with one B. Ravi Kumar, the petitioner herein, who is working in the same company. The petitioner made promise that he will marry her and had physical relationship with her number of times. When the petitioner informed the sister of the de facto complainant that his parents are not accepting her, a quarrel took place between them on 09.03.2025 and 10.03.2025 and thereafter due to the severe mental
agony, the deceased committed suicide by hanging herself to ceiling fan in her hostel. Basing on the same, the present crime has been registered.

Heard Mr.K.Rama Subba Rao, learned counsel representing Smt. T.V. Laxmikantham, learned counsel for the petitioner, and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent.

Learned counsel for the petitioner submits that the petitioner has not committed the offence and he was falsely implicated in the present crime. Even according to the allegations made in the complaint, the ingredients of Sections 69 and 108 of BNS are not attracted against the petitioner. He further submitted that the petitioner was arrested on 11.03.2025 and since then he is in judicial custody. He further submitted that the entire investigation is completed except filing of the charge sheet and the petitioner is not having any criminal antecedents and he is ready and willing to cooperate with the investigation and also ready to abide by the conditions which are going to be imposed by this Court. Hence, the petitioner may be enlarged on bail.

Per contra, learned Additional Public Prosecutor submits that the petitioner has committed grave offence and there are specific allegations against him to attract the ingredients of Sections 69 and 108 of BNS. He further submits that the deceased in her suicide note had specifically mentioned the role of the petitioner and the investigation is under progress. At this stage, the petitioner is not entitled for grant of bail. 6.
Having considered the rival submissions made by the respective parties and after perusal of the material available on record, it reveals that petitioner was arrested on 11.03.2025 and since then he is in judicial custody. Even according to the learned Additional Public Prosecutor, material part of the investigation is completed and the petitioner is not having any other criminal antecedents. It is noteworthy that charge sheet has not been filed till date. Hence, considering the incarceration period, this Court is inclined to grant bail to the petitioner/accused subject to the following conditions.
(i) The petitioner/accused shall execute a personal bond for a sum of Rs.30,000/-(Rupees thirty thousand only) with two sureties for a
like sum each to the satisfaction of the IX Additional Judicial First Class Magistrate, Cyberabad at Medchal.
(ii) After release, the petitioner/accused shall not try to influence any of the prosecution witness in any manner or directly or indirectly try to contact the victim and her family.
(iii) The petitioner/accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C., presently Section 483(3) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
