HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CMA.No.82 of 2008 JUDGMENT:

This appeal is preferred by the claimants against the order dated 05-11-2007 in W.C.No.29 of 2004 passed by the Commissioner for Workmen Compensation and Assistant Commissioner of Labour-II, Circle, Guntur, questioning the liability on the Insurance Company i.e. 2nd respondent. In the said W.C., counter filed by the respondent No.2 shows that the deceased was driving the vehicle, though he was a cleaner, when the driver was sleeping in the cabin and in view of the same, no contra evidence is produced to show that the contents of Ex.A.1 certified copy of F.I.R. filed before the Commissioner are not true. As such, it cannot be said that the Commissioner has committed any error in passing the impugned order. Accordingly, the appeal is dismissed.
