HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 46119 OF 2016 ORDER:
This Writ Petition was filed challenging the action of the 2nd respondent in repeatedly calling and requiring petitioner to be present in Bhimavaram I Town Police Station, in the name of enquiry without there being any Complaint or Crime pending investigation.
The Inspector of Police Bhimavaram I Town Police Station filed counter stating that the Suspect Sheet bearing No. 518 is being maintained on the file of Bhimavaram II Town Police Station, West Godavari District, till date. However, it is stated as follows: "It is submitted that all the allegations of the petitioner against the 2nd respondent are totally false and baseless. It is absolutely false to allege that the 2nd respondent police has been repeatedly calling the petitioner in the name of enquiry and investigation and the petitioner is being put to harassment and inconvenience. The respondents have never harassed, threatened or repeatedly called the petitioner to the police station at any point of time. All these allegations are absolutely false, baseless and made only for the sake of filing the present Writ Petition and the same are hereby specifically denied"
In view of the above, this Writ Petition is closed, as no further orders are necessary. However, it is open to the petitioner to make a representation with regard to the closure of the Suspect Sheet, if the
petitioner is so advised. There shall be no order as to costs. As sequel thereto, Miscellaneous Petitions, pending if any, shall stand closed.
