THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.45354 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to issue a writ of certiorari calling for the records in connection with orders passed in C.M.A.No.59 of 2015 dated 19.11.2016 on the file of 3rd respondent and to quash the same as illegal and void and to set aside the orders in LTR Case No.109 of 2010 dated 10.08.2010 and consequently, to direct the respondents to refrain from interfering with the possession and enjoyment in respect of the land with palm oil standing crop in Sy.No.273/1 of Dammapeta village belonging to the petitioners to an extent of Ac.5.12 guntas.

As against the impugned order of 3rd respondent in C.M.A.No.59 of 2015 dated 19.11.2016, there is a provision for statutory appeal and hence, this Court is not inclined to interfere with the same. The petitioners are directed to prefer an appeal before the appellate authority within the stipulated period. Further the petitioners as well as respondents are directed to maintain status quo with regard to possession of the subject-land till the petitioners file the statutory appeal within the stipulated period. The petitioners are at liberty to seek for any interim relief at the time of filing of appeal before the appellate authority. Accordingly, the Writ Petition is disposed of. No costs.
