SMT JUSTICE T.RAJANI CRIMINAL PETITION No.12863 OF 2011 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the Petitioner/Accused seeking to quash the proceedings in Crime No.97 of 2011, on the file of the Station House Officer, Vuyyuru Police Station, Vijayawada City, Krishna District, registered for the offences punishable under Sections 290 and 506 of I.P.C.

Heard learned counsel for the petitioner, learned Public Prosecutor appearing for the 1st respondent - State, and learned counsel for the 2nd respondent - de-facto complainant.

The allegations in the complaint are that the petitioner herein gave a speech creating fear among the Journalists and also stated that he would kill them through an accident. The complainant, who was also presiding over the said meeting as President, took an objection with regard to the speech of the petitioner and when he returned on his vehicle, the petitioner went to the complainant and threatened that he would see his end. 4.

Learned counsel for the petitioner submits, on the same day, the petitioner gave a representation to the Chairman, Human Rights Commission and that this complaint is filed as a counter-blast to the his complaint. 5.

But, a perusal of the complaint, which is addressed to the Human Rights Commission, shows that the main allegations are made against the 2nd respondent - Sub-Inspector of Police, Vuyyuru Police Station. 6.

Hence, this Court opines that the complaint on the face of it cannot be considered as a counter-blast to the complaint filed by the petitioner and the truth of the matter has to be got verified only during the trial. 7.

Accordingly, with the above observation, the Criminal Petition is dismissed.

As a sequel, the miscellaneous petitions, if any pending, shall stand dismissed.
