THE HON'BLE THE CHI EF JUSTI CE SRI RAGHVENDRA SI NGH CHAUHAN AND THE HON'BLE DR. JUSTI CE SHAMEEM AKTHER CONTEMPT APPEAL No.1 3 of 2 0 1 9 JUDGMENT: { Per the Hon'ble the Chief Justice Sri Justice Raghvendra Singh Chauhan} The appellant has challenged the legality of the order dated 08.07.2019, passed by the learned single Judge, in CC.No.2830 of 2018, whereby the learned single Judge had imposed a fine of Rs.2,000/ - upon the appellant, and has directed the Commissioner, Greater Hyderabad Municipal Corporation ('GHMC' for short) to initiate disciplinary action against the appellant for willful disobedience of the orders passed by this Court, and to record an adverse entry in the service record of the appellant. The learned Judge had also issued a warning to the appellant to be careful in future while dealing with any order passed by this Court.

Mr. Nazir Ahmed Khan, learned counsel for respondent No.1, informs this Court that the complainant, Mr. S. Muniruddin, is no longer alive. However, once a contempt petition is filed, the matter is between the Court and the Contemnor. Therefore, even if the complainant is no longer alive, it would not make any difference to the pendency of the present appeal.

Mr. K. Ravi Kumar, the appellant, has appeared before this Court. He has tendered an unconditional apology, and given an undertaking before this Court that even in future he would not commit any contempt of the Court. The apology is duly accepted by this Court.

Therefore, the imposition of the fine of Rs.2,000/ -, and the direction to the Commissioner, GHMC to initiate disciplinary action, and to record an adverse entry in the service record of the appellant, as directed by the learned Judge, is hereby deleted from the impugned order.

With these observations, the contempt appeal stands disposed of. Pending miscellaneous petitions shall also stand dismissed. There shall be no order as to costs.
