THE HONOURABLE SRI JUSTICE M. SATYANARAYANA MURTHY WRIT PETITION No.5016 OF 2001 ORDER:

This writ petition filed for issue of writ of Certiorari quashing the proceedings of the 1s t respondent dated 23.11.2000 in proceedings No.F1/HBA(2281)/2000 which was not communicated to the petitioner and the consequential order passed by the 2nd respondent vide proceedings No.M2/8(2)-2000-ZWS-VZM, dated 14.12.2000 as illegal, arbitrary and contrary to the rules and regulations of the APSRTC Staff Retirement Benefit Scheme and also principles of natural justice, consequently direct the respondents 1 to 4 not to deduct the amounts from petitioner salary towards the loan due to the Corporation from the 5th respondent.

02. A similar relief was sought in W.P. No.4727 of 2001 by other employees V. Sankara Rao and G. Guru Swamy. The said writ petition was dismissed by Order dated 12.07.2004.

03. The learned counsel for the petitioners and the respondents submitted that the issue involved in the present writ petition is squarely covered by the Order dated 12.07.2001 in W.P. No.4727 of 2001.

04. In view of the Order in W.P. No.4727 of 2001 and in terms thereof, the writ petition is dismissed. No costs. Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
