V. Amala v. The State Of Telangana,
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.16335 OF 2019 ORDER:
Heard.
2. According to the petitioner, she is in joint possession of the property bearing H.No.6-7-59 Bansilalpet, Bible House, Secunderabad, to an extent of 98 sq. yards along with her brother, 6th respondent herein. This is a government land. Taking advantage of the policy of the Government notified in G.O.Ms.No.59 dated 30.12.2014 to assign lands to the occupants who are in occupation of the unobjectionable government land, the petitioner claims to have applied for regularization on 14.12.2016. Petitioner also alleges that her brother also applied for regularization under the said scheme. Petitioner now apprehends that though petitioner also filed application, the 6th respondent is likely to secure orders regularizing the plot in his own name depriving the entitlement of the petitioner and hence this writ petition.
3. As briefly noted above, from the averments and the prayer in the writ petition, it is apparent that so far no decision is taken by the competent authority on the claim for regularization said to have been made by the unofficial respondent ignoring the claim of the petitioner. Hence, this Court is not inclined to entertain the writ petition. A decision of the competent authority can be tested within the well laid down parameters and this Court cannot undertake the judicial review even before the decision is made.
4. Therefore, leaving it open to the petitioner to work out her remedies, as available in law, the Writ Petition is dismissed. Pending miscellaneous petitions, in any, shall stand closed. No order as to costs.
