HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.8192 OF 2017 ORDER:

This writ petition is filed declaring the action of the respondents in dispossessing the petitioners from their lawful and peaceful possession of their agricultural land to an extent of Sy.No.453 of Karlapalem Village and Mandal, Guntur District, as illegal and arbitrary.

Counter affidavit is filed by the 1st respondent stating that as per RSR of Karlapalem Village, an extent of Ac.3-00 cents in Sy.No.453 of Karlapalem is classified as Malapalli Gramakantam Poramboke with houses and not assigned to anyone. It is further stated that neither the Tahsildar, Karlapalem nor his staff have intention to dispossess the petitioners from the subject land, though it is a Government land. As and when the Government intends to evict the petitioners, the authorities will follow due process of law. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue.

In view of the averments in counter affidavit filed by the respondents, the writ petition is disposed of with a direction to the respondents not to evict the petitioners, without following due process of law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
