THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16336 of 2019 O R D E R:

This Writ Petition is filed for the following relief: "....to declare the action of the respondents in insisting for submission of NOC from MRO / Revenue Department on the ground that the site U/r is falling in Sy.No. 66/2 of Raidurg Nowkhalsa which is notified by the revenue department under Section 22-A of the Registration Act, 1908 and covered under O.S.No. 92 of 2004 for processing the building permission application of the petitioner under File No. 3/C20/097873/2019 as being illegal, arbitrary, violative of Articles 14, 21 and 300-A of the Constitution and Greater Hyderabad Municipal Corporation Act, 1955....."

When the matter is taken up, it is submitted by the learned counsel for the petitioner as well as learned Standing Counsel for GHMC that the subject matter of the present Writ Petition is squarely covered by the order dated 04.07.2019 passed by this Court in Writ Petition No. 13440 of 2019 and therefore, similar order may be passed even in this Writ Petition.

The operative portion of the order dated 04.07.2019 reads as under:

However, in order to resolve the dispute, with consent of both counsel, the Writ Petition is disposed of directing the Deputy Commissioner, Circle No.11, GHMC - 2nd respondent to conduct field inspection in the presence of petitioner. At the time of field inspection, petitioner shall point out clear demarcations of his site matching with the boundaries specified in the Land Regularization Order and on being satisfied that there is clear demarcation, he shall process the building permission application without insisting for No Objection Certificate from the revenue authorities. If

there is any other objection, the same shall be communicated to the petitioner. "

In terms of the order dated 04.07.2019 in Writ Petition No. 13440 of 2019 and for the reasons alike, this Writ Petition is also disposed of. No costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall also stand disposed of.
